What Is a Final Designation Report? How Leading Privacy Teams Document AI Tool Decisions

Most organizations make AI tool decisions informally and document them poorly. Here is what a governance-grade decision record actually looks like and why it matters when a regulator comes asking.

Picture this scenario.

Your organization deployed an AI tool eighteen months ago. The privacy team reviewed it at the time. Someone sent the vendor a questionnaire. There were some email exchanges about the DPA. Eventually someone said it was fine to proceed. The tool went into production and has been in use ever since.

Now a supervisory authority is asking questions. They want to know what due diligence was conducted before deployment. They want to see the documentation. They want to understand what risks were identified, how they were assessed, and what decision was made and by whom.

You search your email. You find the questionnaire that was sent to the vendor, and the vendor's response, which is mostly marketing language with a few relevant facts embedded in paragraphs of reassurance. You find an email thread in which someone from legal said it seemed okay. You find a Jira ticket that was closed with a comment saying the review was complete.

What you do not have is a document that clearly states what the tool was assessed against, what was found, what decision was made, what conditions were attached to that decision, and why. You do not have a record that can be presented to a regulator as evidence that your organization conducted a proper review.

This is the governance gap that a Final Designation Report is designed to close.


What a Final Designation Report Is

A Final Designation Report is the permanent, archived record of an AI tool assessment. It is the document that answers, definitively and in one place, three questions that any regulator, auditor, or executive should be able to get answered about any AI tool your organization has deployed.

The three questions are: what did you assess, what did you find, and what did you decide.

That sounds simple. In practice, most organizations cannot answer all three questions for most of the AI tools they are using, because the information is scattered across email threads, shared documents, and ticket systems that were never designed to serve as compliance records.

A Final Designation Report consolidates that information into a single permanent record with a defined structure, a clear decision, documented rationale, and an integrity mechanism that proves the record has not been altered after the fact.


The Anatomy of a Governance-Grade Designation Record

Not every document that purports to record an AI tool decision is a governance-grade record. The difference between a document that will hold up under regulatory scrutiny and one that will not comes down to what it contains and how it is structured.

A governance-grade Final Designation Report contains several essential elements.

The assessment identity.

The report needs a unique identifier that allows it to be referenced precisely. The tool name and the specific feature or deployment being assessed, not just the vendor name in the abstract. The organization conducting the assessment and the industry profile that shaped the regulatory framework applied. The date the assessment was conducted and, if this is a reassessment, the version number and a reference to the prior designation.

Why this matters: if an organization assesses the same tool twice because the use case has changed, or reassesses it because a prior denial has been resolved, the version history needs to be clear. A regulator asking about a specific deployment needs to be able to trace the assessment history of that specific deployment, not just locate a document that mentions the vendor's name.

The designation decision.

The decision needs to be stated explicitly, unambiguously, and prominently. Approved. Approved with Conditions. Denied. Not "generally acceptable with some caveats" or "proceed with caution." A definitive decision.

The designation decision also needs to record who made it and when. Not the name of the tool that generated the analysis. The name of the human being at your organization who reviewed the findings and exercised organizational judgment to reach a decision. AI tools can surface findings and synthesize regulatory analysis. The designation decision belongs to a person.

The conditions, if any.

For an Approved with Conditions designation, the conditions are not an appendix or a suggestion. They are the governance decision. They need to be specific enough to be enforceable, specific enough to be auditable, and specific enough that any employee reading them understands exactly what they are and are not permitted to do with the tool.

Conditions that lack specificity are not conditions. "Use with appropriate care" is not a condition. "Approved for use by the legal team for internal document drafting only. Prohibited for processing personal data of any identified individual. No personally identifiable information to be included in prompts. Authorized users must complete AI literacy training before access is granted" is a condition.

The findings.

The regulatory findings are the substance of the assessment. Each finding should identify the regulatory framework and specific provision implicated, describe the compliance gap or risk that was identified, assign a severity level, and state a recommended action.

The specificity of the regulatory citation is what distinguishes a compliance finding from a general concern. "GDPR issues" is not a finding. "GDPR Article 28: No data processing agreement in place covering AI inference processing activities. Required before any personal data of EU residents is processed through this tool" is a finding. The difference is that the second version tells the person reading it exactly what regulation requires, exactly what is missing, and exactly what needs to happen.

The action items.

Findings that cannot be remediated immediately generate action items. Each action item should state what needs to happen, who is responsible for it, whether it is a blocker that must be resolved before the tool can be used or a required action that needs to happen within a defined timeframe, and what the current status is.

The action item record is also the ongoing governance mechanism for conditions. If an Approved with Conditions designation requires a BAA addendum to be executed within thirty days, that requirement needs to live somewhere as an assigned, tracked action item, not just as a note in a document that nobody is monitoring.

The integrity mechanism.

A Final Designation Report is only as reliable as its integrity. If the document can be modified after the fact, its value as evidence is significantly diminished. A governance-grade designation record should include a mechanism that demonstrates the record was created at a specific time and has not been altered since.

In practice, this means generating a cryptographic hash of the document at the time of creation and recording that hash as part of the permanent record. If the document is ever presented as evidence of what was assessed and decided, the hash can be verified to confirm that the document has not been modified. This is not a technical nicety. It is the difference between a document that can be trusted and a document that cannot be verified.

The permanent archive status.

A designation record is not a working document. It is not a draft. Once a designation decision has been recorded, the report should be locked and treated as a permanent archive. If circumstances change and a reassessment is needed, a new report is created for the new assessment. The original report remains unchanged as the historical record of what was assessed and decided at that point in time.


Why the Record Matters More Than the Decision

There is a temptation to treat the Final Designation Report as primarily a record of the decision. Approved or denied, conditions attached or not. The decision is what the business cares about. The decision is what determines whether the tool goes into production.

But from a regulatory and governance perspective, the record is often more important than the decision itself.

Consider two scenarios.

In the first scenario, an organization deploys an AI tool after a thorough assessment. The assessment identifies several significant compliance gaps. Some are resolved before deployment. Others are accepted as residual risk with documented rationale. The tool goes into production. Eighteen months later, a data breach occurs involving the AI tool. The supervisory authority investigates.

In this scenario, the organization can show a complete assessment record. They can show the findings that were identified, the ones that were remediated, and the ones that were accepted as residual risk with documented reasoning. They can show the conditions that were attached to the approval and whether those conditions were met. They can show that the decision was made thoughtfully, by a named individual, with full awareness of the risks involved.

In the second scenario, an organization deploys the same tool after an informal review. The review identifies some of the same gaps. The gaps are noted in an email and the tool proceeds to production. The same breach occurs. The supervisory authority investigates.

In the second scenario, the organization cannot demonstrate that a systematic assessment was conducted. They cannot show what was found and what was decided about each finding. They cannot show that the decision was made with documented awareness of the risks. The email thread does not demonstrate due diligence. It demonstrates that some people exchanged some words about the tool before it went live.

The regulatory consequence of the second scenario is significantly worse than the first, not because the organization made a worse decision, but because they cannot demonstrate they made a decision at all.


Version History as a Governance Asset

One of the most practically valuable features of a well-structured designation record is version history. The ability to show not just the current status of an AI tool assessment but the complete history of how that assessment evolved over time.

Version history matters in several specific situations.

When a tool is initially denied and later approved after the vendor addresses the identified gaps, the version history demonstrates that the original concerns were real, that the organization held its position until those concerns were addressed, and that the subsequent approval was based on specific documented changes rather than organizational fatigue or stakeholder pressure.

When a tool approved for one use case is later requested for a different use case, the version history makes clear that the original approval was scoped to specific conditions and that the new use case requires its own assessment.

When a supervisory authority investigates a specific incident and asks whether the organization identified the relevant risk before deployment, the version history of the assessment record can demonstrate that the risk was or was not known at the time of the original designation.

Version history is not just an administrative convenience. It is evidence of the evolution of an organization's AI governance thinking, and evidence of the rigor with which governance decisions were made and documented.


What the Absence of This Record Looks Like

For organizations that have been assessing AI tools informally, without structured records, without explicit designation decisions, and without version history, the practical implication of this discussion is straightforward.

At some point, someone is going to ask for documentation of the due diligence conducted before an AI tool was deployed. That someone might be a supervisory authority following up on a complaint or a breach. It might be an internal auditor conducting a review of the organization's AI governance program. It might be a board member, a CISO, or a general counsel who wants to understand the organization's exposure. It might be a prospective customer or partner conducting vendor due diligence.

When that question is asked, the answer needs to be a record. Not a recollection. Not an email thread. Not a description of the process that was followed in general terms. A specific, structured, permanent record of what was assessed, what was found, and what was decided about the specific tool in question.

Organizations that have that record are in a position to answer the question. Organizations that do not have it are in a position to explain why they do not.

That explanation rarely goes well.
