    Corrected entity scope and removed a fabricated cross-border-transfer duty (Sec. 25/27/28)

    Primary-source review of the Privacy Act, 2075 (2018) confirmed that Sec. 25 (security), Sec. 27 (sensitive-information non-processing), and Sec. 28 (correction application) textually bind Nepali public bodies only — they are not extended to private body corporates on the statute's face. Findings for these three sections now carry an explicit public-body scope note and state that Sec. 12 (consent) and Sec. 26 (use restriction), which do bind body corporates directly, still apply regardless of entity type. Separately, Sec. 27 was previously mislabeled as a cross-border-transfer-safeguard duty (an earlier version cited this as "Sec. 15", a reputation/defamation provision, before a partial correction relabeled it "Sec. 27" without fixing the substance). No cross-border-transfer duty exists anywhere in the Act's text. Sec. 27's actual subject is a bar on public-body processing of sensitive personal information (caste/ethnicity, political affiliation, religion, health, sexual orientation, property) outside narrow statutory exceptions. Findings nepal-privacy-act:primary, provision:3, and usecase:2 have been rewritten to reflect this. This is a material correction: prior content could have asserted Sec. 25/27/28 duties, including a nonexistent transfer-safeguard duty, against private-sector AI deployers the statute does not bind. Report holders whose Nepal analysis may be affected should regenerate under the standard complimentary rescan window.
